BAARS Media Privacy Policy

This is an English translation provided for convenience. In the event of any discrepancy, the Dutch version shall prevail.

Article 1 - Definitions

1.1 BAARS Media: the sole proprietorship BAARS Media, established in Tilburg, registered with the Netherlands Chamber of Commerce (KvK) under number 23084776, VAT number NL003265285B16.

1.2 Data subject: the natural person to whom the personal data relates.

1.3 Personal data: any information relating to an identified or identifiable natural person.

1.4 Processing: any operation performed on personal data.

1.5 GDPR: General Data Protection Regulation (in Dutch: AVG).

Article 2 - Controller

2.1 BAARS Media is responsible for the processing of personal data as set out in this privacy policy.

Article 3 - Personal data we process

3.1 BAARS Media processes personal data that you provide to us yourself through the use of our services and/or because you provide this data to us.

3.2 The personal data we process may include:

First and last name
Address details
Telephone number
Email address
IP address
Other personal data that you actively provide
Bank account number (if applicable)

Article 4 - Purposes and legal bases

4.1 BAARS Media processes your personal data for the following purposes:

Processing your payment
Sending our newsletter (if you have subscribed to it)
Being able to call or email you if this is necessary for our services
Informing you about changes to our services and products
Delivering goods and services to you
BAARS Media also processes personal data where we are legally required to do so

Article 5 - Retention periods

5.1 BAARS Media does not retain your personal data for longer than is strictly necessary to achieve the purposes for which your data is collected.

5.2 We apply the following retention periods:

Customer data: 7 years (statutory tax retention obligation)
Data of prospective customers: 1 year after last contact
Audition demos and candidate data for a casting call: within 3 months after the project ends, unless the candidate gives permission to keep them longer for future productions

Article 6 - Sharing personal data with third parties

6.1 BAARS Media does not sell your data to third parties and only provides it where this is necessary for the performance of our agreement with you or to comply with a legal obligation.

6.2 With companies that process your data on our behalf, we conclude a data processing agreement to ensure the same level of security and confidentiality of your data.

6.3 To receive and store files and data that you submit through our website, such as audition demos, BAARS Media uses Google Drive, Google Sheets and Google Apps Script with a personal Google account. These services are used under Google’s standard terms; no separate data processing agreement has been concluded with Google for this use. Google may also process data outside the European Economic Area. Only BAARS Media has access to the stored files. Demos are only shared with the client of the casting, for the purpose of choosing the voices.

Article 7 - Cookies or similar technologies

7.1 BAARS Media only uses technical, functional and analytical cookies that do not infringe on your privacy.

Article 8 - Accessing, correcting or deleting your data

8.1 You have the right to access, correct or delete your personal data.

8.2 You can submit a request for access, correction or deletion of your personal data, or a request to withdraw your consent or object to the processing of your personal data, by contacting BAARS Media.

8.3 BAARS Media would also like to point out that you have the option to file a complaint with the national supervisory authority, the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).

Article 9 - Security of personal data

9.1 BAARS Media takes the protection of your data seriously and takes appropriate measures to prevent misuse, loss, unauthorised access, unwanted disclosure and unauthorised modification.

9.2 If you feel that your data is not properly secured or there are indications of misuse, please contact BAARS Media at mark@baars.tv.

Article 10 - Changes to the privacy policy

10.1 BAARS Media may amend this privacy policy. New versions will always be published on the website.

10.2 We recommend that you consult this statement regularly so that you remain informed of any changes.
